ZAMBOANGA City Legal Officer Jesus Carbon announced that the city councilors can utilize their Community Development Fund (CDF).
Carbon made the announcement citing that the CDF of the local legislators is not unconstitutional unlike the Priority Development Assistance Fund (PDAF) of senators and congressmen as declared by the Supreme Court.
The High Court has declared the PDAF, otherwise known as the pork barrel, as unconstitutional in November of last year with 14-0-1 (favor-against-abstention) vote.
“The Supreme Court has declared unconstitutional only the PDAF and did not say the CDF is also unconstitutional,” Carbon, a retired judge, explained citing PDAF is a National Government allocation while the CDF is locally funded.
Carbon said the city councilors could utilize their CDFs either as infrastructure fund, intelligence fund, and calamity fund which are line items.
Each of the city councilors has an annual CDF of P2 million for the implementation of development projects and for providing assistance to local residents as the need arises.
The city councilors’ CDF allocation is incorporated in the annual budget of the local government.
