Mayor, 2 others face raps for unpaid GSIS premiums

THE mayor and two other officials of San Sebastian, Samar are facing charges at the Sandiganbayan for alleged failure to file and remit on time the monthly Government Service Insurance System (GSIS) premiums of their employees from 2008 to 2012.

In a resolution, the Office of the Ombudsman found sufficient evidence to indict Mayor Arnold Abalos, Municipal Treasurer Virginia Uy, and Municipal Accountant Pepita Mabini of 40 counts of violation of Section 5(c) in relation to 52(g) of The Government Service Insurance System Act of 1997 (Republic Act 8291).

The Ombudsman, however, junked a charge for malversation of public funds against the officials for insufficiency of evidence.


Based on the statement of account issued on May 31, 2012 by GSIS, the municipality did not remit the GSIS premiums covering the months of April 2008 to December 2009, May to September 2010, February to July 2011, September to December 2011, and January to April 2012 corresponding to arrears amounting to P6,786,787.84.

The GSIS Collection Notice dated August 17, 2012 also indicated that San Sebastian has outstanding payables amounting to P7,633,236.08.

Section 5(c) of RA 8291 penalizes employers who fail to include the payment of contributions in their annual appropriations or otherwise fail to remit or delay the exact amount of monthly contributions. (Sunnex)
