King's 'triggerman' to stay in DCPO jail

WHILE the two siblings linked to the murder of Cebuano businessman Richard Lim King will be transferred to the Davao City Jail, the Regional Trial Court (RTC) Davao City Branch 17 granted the request of the alleged triggerman to be detained at the Davao City Police Office (DCPO) detention facility.

RTC Branch 17 Judge Evalyn Morales, in her order dated July 3, granted the motion filed by Lawyer Ben Joseph Tesiorna for his client Paul Dave Molina Labang who requested to be detained at the DCPO Investigation and Detection Management Branch (DCPO-IDMB).
Tesiorna cited in his motion dated July 2 that the life of his client is in danger after he implicated Supt. Leonardo Felonia in the killing of the businessman last June 12.

“Comes now accused Paul Dave Molina Labang, to this honorable court most respectfully avers that among the reasons cited by the said respondents for having given themselves up voluntarily to the police authorities is that they are in constant fear for their lives, considering that they have implicated Felonia as the one who hired them to kill the late Richard Lim King. The testimony of the accused is very vital for the said murder case investigation to be completely solved, considering the fact that he has executed an extrajudicial confession along with his co-respondents Rommel and Rodel dela Cerna and that they have mentioned Felonia, it is an imperative that their safety be ensured,” the motion read.


Morales found merit in the motion and added that Public Prosecutor Carlos Castaños Jr. had no objections in the request.

The court judge also issued a commitment order allowing the operatives of DCPO-IDMB to retain Labang in their detention facility and take him to court during any scheduled hearing.

Tesiorna has also showed his intention to have his clients be named as state witness as he believes that the three suspects have vital information that can aid in the prosecution of Felonia.

But while a separate murder case was already filed against Felonia, fiscal PanfiloLovitos of the Davao City Prosecution Office is yet to find probable cause to charge him.
