Proclamations prevent bizmen to develop Isla Verde

INVESTORS have expressed interest to develop a coastal area along Quezon Boulevard, where the recent massive fire transpired, but a national law prevents them from doing so.

Davao City Mayor Rodrigo Duterte said the area in Isla Verde, which was affected by the fire, is covered by Presidential Proclamation 85 and 2114.

"The presidential proclamation is a hindrance. You cannot enter into any development in the area aside from what was in the condition," Duterte told reporters in an interview.


He said the two presidential proclamations provide that the area will only be available as "a human settlement site" and for "park and playground purposes."

For instance, Duterte said a Malaysian investor wants to develop the place into a commercial area.

The investor, he said, is willing to pour in a total investment of P3 billion for the proposed project.

"Gusto nila idevelop and reserve a portion of the total area as tenement housing. Okay sana kaso ang problema is they will develop the area not only for tenement housing but commercial undertaking," he said.

Former President Joseph Ejercito Estrada, through Presidential Proclamation 85, proclaimed the Isla Verde as human settlement site. The land covered has an area of 123,201 square meters.

The proclamation states that Isla Verde is "declared open for disposition, except those which are being used or earmarked for public or quasi-public purposes."

"Further, lands disposed under the proclamation shall not be subject to alienation and encumbrance for a term of 10 years from the issuance of the deed of sale/conveyance, in case of sale, or execution of any debt contracted prior to the expiration of the said period, except for housing loan purposes, but the improvements on the land may be mortgaged to qualified persons, association or corporations," it added.

Meanwhile, former President Ferdinand E. Marcos, though Proclamation 2114, reserved the parcels of land in the foreshore area of Piapi District as slum improvement and resettlement and for park and playground.

As much as Duterte wants to welcome the investors in the area, the national policy prohibits them from proceeding.

"Only the president can change the proclamation," Duterte said. "Ask the president to amend the proclamation." (ANC)
