No charges yet for 35 ‘drug suspects’-A A +A

AUTHORITIES have yet to file charges before the City Prosecution Office (CPO) against 35 alleged drug pushers and users, including a Korean national, arrested in a raid at Barangay Ilang, Davao City on Friday.
Criminal Investigation and Detection Group (CIDG) regional director Joel Pernito said in an interview that the suspects will be charged with violation of Republic Act 9165 or The Comprehensive Dangerous Drugs Act of 2002.
"The charges to be filed against the suspects will depend on the evidence na nakuha natin sa kanilang pamamahay or sa individual mismo. Sa dami nila we have to check each of them kasi meron din mga nahuli na drug pushers or users na wala sa search warrant," Pernito said.
Emerson Rosales, director of the Philippine Drugs Enforcement Agency (PDEA) in Davao Region, said the drug pushers and users will be both charged with violation of Section 11 (Possession of Dangerous Drugs), of the Republic Act 9165.
Rosales added that Section 5 (Sale of Dangerous Drugs) in relation to Section 6 (Maintenance of den) and Section 14 (Possession of Paraphernalia) will only be relevant to suspected drug pushers, while Section 7 (Employees or Visitors of a Den) in relation to Section 15 (Use of Drugs) will be charged against drug users.
He also said drug pushers can also be charged with violation of Section 15 (Use of Dangerous Drugs) if any of them will be tested positive of using the substance. He added that the penalty for each will depend to provisions of the drugs law that have been violated.
The raid happened a day after Davao City Mayor Rodrigo Duterte announced he will reward those who can give him information about illegal drug trades in the city.
