Bizman sued for substandard fertilizer

CHARGES were filed before the City Prosecutor's Office against the owner of the warehouses where the National Bureau of Investigation (NBI) in Davao Region seized some 100,000 sacks of suspected substandard fertilizers in an operation in Davao City on January 16.

Facing charges for violation of Presidential Decree 1144 or the Fertilizer and Pesticide Act is So Peng Kee, owner of the Moderntimes warehouses located on Km. 7, Lanang.

Kee was charged after the NBI seized the adulterated fertilizers in three of his warehouses. Aside from the sacks of adulterated fertilizer, the agency also spotted various equipment used to mix and repack the fertilizers.

The NBI-Davao, led by lawyer Dante Gierran, implemented a search warrant issued by Regional Trial Court (RTC)-Davao City executive judge Pelagio Paguican after the Fertilizer and Pesticide Authority (FPA) received complaints from farmers that the fertilizers coming from the warehouses owned by Kee were ineffective. This aroused suspicion that the workers in the warehouses were engaging in unlawful mixing of fertilizers.

NBI-Davao Assistant Regional Director Eric Distor, in a recent interview, said the implementation of the search warrant was peacefully conducted with the assistance of the Davao City Police Office and the presence of the respondent and his legal counsel Marcos Chua.

The FPA, which conducted a parallel examination on the chemical components of the alleged adulterated fertilizers, affirmed that the sacks of fertilizers were indeed altered.

A source from the City Prosecutor's Office who refused to reveal his identity said the case has not yet been raffled off to a branch of RTC or the Municipal Trial Court in Cities (MTCC) but the City Prosecutor's Office is expected to release a resolution on the complaint within the week.
