THE family of the 26-year-old man allegedly shot and killed by a police officer in Lapu-Lapu City last Tuesday plans to file a murder case against the suspect, the police said.

The police prepared affidavits to file homicide charges against PO2 Franklin Bulaquia, 37, but family members of Golgie Donor came to the Lapu-Lapu City Police Office (LLCPO) and said they will file a murder case instead.

PO3 Lydo Pinos of the LLCPO Homicide Section said they were supposed to file homicide charges against the suspect yesterday.

“We were going to file a homicide case because there was a struggle between the suspect and the victim before the latter was killed,” Pinos told Sun.Star Cebu yesterday.

Pinos said the family has until Friday morning to file the murder case to keep Bulaquia in the detention cell.

A murder case is filed against a person who killed another person with premeditation or a plan to kill.

Bulaquia surrendered to the Mabolo Police Station in Cebu City, where he was assigned, hours after the incident, which took place in Sitio Kawat, Barangay Babag in Lapu-Lapu.

He said he accidentally shot the victim, who was a brother of his live-in partner.

Police investigation revealed that Golgie and his brother were having breakfast inside their house when Bulaquia came with a .9mm pistol.

The police officer allegedly kicked the siblings. Golgie tried to stop him, but was shot twice instead. He was pronounced dead at the Mactan Doctors Hospital. Two shells from a .9mm pistol were recovered from the crime scene.
