THE Vallacar Transit Corp. blamed a bad road and bad weather for the June 22 accident in Carmen, Cebu involving a Ceres bus.
In a hearing yesterday, Vallacar Transit administrative branch manager Rennan Villahermosa told Land Transportation Franchising and Regulatory Board (LTFRB) 7 Legal Officer Edwin Antipuesto that the road was slippery because it was raining.
The road condition caused the Ceres bus to skid and hit a concrete fence. Thirty-eight passengers of the bus were reportedly hurt during the accident.
Department of Public Works and Highways (DPWH) 7 Director Ador Canlas could not be reached for comment as of press time yesterday.
Antipuesto said the hearing was conducted to determine whether Vallacar's franchise would be suspended or revoked.
He said he will also look into the possibility of human error after Villehermosa admitted that bus driver Ronald Lato swerved left then right to pass a tricycle that made a sudden stop.
The bus hit the fence after it tried to get back to its lane.
Villahermosa denied that one of the tires of the bus exploded, causing the accident.
He told Antipuesto that all the tires of the bus were new and were installed four days before the accident.
Villahermosa said the bus driver, who is still in the custody of the Carmen Police, has worked in the company since June 10, 2010 and has never been involved in an accident until last June 22.
Lawyer Jose Vicente Arnado, counsel of Vallacar, said his client paid a total of P95,463.04 for the medical bills of 28 patients who executed affidavits of desistance.
He said Vallacar will submit the affidavits in court to support its motion to dismiss the case against the driver.
The lawyer said Vallacar exercised due deligence by conducting continuous trainings to drivers and conductors, and ensuring proper maintenance of its buses.
Antipuesto said he will look into the maintenance of Ceres buses, trainings of drivers, behavior of the driver and speed of the bus when the accident happened. He added that he will also check if the body of the bus was a factor in the accident.
