Man charged for having sex

FOR having sex in front of a 15-year-old girl, a 34-year-old man will face trial for violation of Republic Act (RA) 7610 or the Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act.

The Cebu City Prosecutor's Office found enough evidence to indict Stu (real name withheld) for being intimate with his live-in partner.

Stu's partner is the girl's older sister.


The complainant, Meka (real name also withheld as provided under the law), said Stu told her to watch him having sex with her older sister in the house they shared in July last year.

"I just turned my back and covered myself with a blanket," she said.

In her sworn affidavit, Meka claimed that Stu also asked to have sex with her the following day but she refused.

Meka was then a junior in high school.

Two weeks later, Meka woke up stunned since she was already naked and she had no idea what Stu did to her.


Last Nov. 24, Stu tried to rape Meka while she was asleep. But she woke up and kicked him.

Meka said she did not shout fearing that Stu might harm her. She just covered herself with a blanket and fell back to sleep.

She eventually told her mother about the abuses she received from Stu.

The mother and daughter then reported the incidents to the police.

The prosecutor's office, in its resolution, said that the abuse “would show that the sexual perversion of respondent is prejudicial to the growth and development of the youngster.”

Section 10 of RA 7610 punishes any person who shall commit any other acts of child abuse, cruelty, or exploitation or to be responsible for other conditions prejudicial to the child's development.

Bail was set at P120,000 for the accused, whose case was resolved after he failed to submit his counter-affidavit to answer the allegations.

RA 7610 defines child abuse as maltreatment of a minor, which includes "psychological and physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment" and any act by deeds or words which debases, degrades or demeans the intrinsic worth and dignity of a child as a human being.
