Trader sues Capitol

A BUSINESSMAN has hauled the Cebu Provincial Government to court, arguing that its ordinance requiring sand and gravel haulers to secure accreditation stickers annually “appears to be oppressive, illegal.”

Larry Estacion, of Dumaguete City, filed a civil case before the Regional Trial Court in Cebu City against the Provincial Government and the Provincial Legal Office.

Estacion wants the court to issue a temporary restraining order, injunction and declaratory relief against Provincial Ordinance 2008-10.


Estacion owns LTE Trucking, which is engaged in hauling and transporting sand and gravel mineral products in Sibulan, Oriental Negros.


He also delivers to Cebu City, using the southwestern town of Samboan, Cebu as his trucks’ point of entry.

Last April 1, Estacion said, his cargo truck mover and trailer, which were loaded with sand and gravel, were impounded in Barangay Tuyan, Naga City for not having an accreditation sticker from the Capitol.

Estacion said there’s a possibility that Capitol’s apprehending team will continue to impound his trucks and confiscate the license of his drivers.

The businessman said the defendants made “unjustified apprehension” of his cargo trucks, vans, and trailers, which caused him “great irreparable damage.”

He said it was carried out in “a very unceremonious and nonprocedural manner....” (GMD)
