Davide suspends Dumanjug mayor

CEBU Gov. Hilario Davide III yesterday ordered the 60-day preventive suspension of Dumanjug Mayor Nelson Garcia, as recommended by the Provincial Board (PB), for grave abuse of authority.

In his three-page order, the governor said he fully supports the findings and conclusions of the PB’s Committee on Complaints and Investigation and the Provincial Board, which acted on the administrative complaint filed by Dumanjug Vice Mayor Efren Gica.

Davide said he personally wrote the order.


“I issued the order. It’s not that I just affixed my signature,” Davide said, adding that he found it reasonable to place Garcia under preventive suspension.

Provincial Legal Officer Orvi Ortega served the suspension order to Garcia’s office. The suspension will take effect once Garcia gets a copy of Davide’s order.

A staff from the governor’s office, however, said the order was posted inside the mayor’s office after Garcia’s secretary declined to receive the order.

Garcia, who was out of town for a meeting, said in an interview that he was not informed by his staff about the suspension order.

He believes that the suspension is a result of politics.

Garcia belongs to One Cebu, headed by former governor and now Rep. Gwendolyn Garcia (3rd district).

Gica is an ally of the ruling Liberal Party.

Garcia said the PB just pressured Davide to issue the order and that he cannot get justice from the Provincial Board.

“I leave this up to God and (hope that) law (will prevail),” Garcia said.

He also said that only his function as a mayor was suspended.

“I’m still the mayor. The suspension is just like I’m having a vacation,” Garcia added.

The suspension stemmed from a complaint filed by Gica in September last year after Garcia allegedly usurped the power of the vice mayor when the mayor appointed a new Sangguniang Bayan secretary.
