Complainant vows to file graft and corruption vs ranking cop, aide

LAWYER Ernie Palanan vows to file graft and corrupt practices against the ranking police officer and his aide who are out on bail Wednesday afternoon.

Police Superintendent John Michael Deloso, former Traffic Unit chief of Cagayan de Oro Police Office, and Police Officer 3 Ernesto Galleto, Deloso’s aide, are now facing direct bribery charges after the City Prosecutor’s Office found a probable cause of their case.

In his pursuit to seek justice, Palanan told Sun.Star Cagayan de Oro by phone Wednesday evening that he has readied the affidavits to file another case against Deloso and Galleto. This time, it will be on violations of Republic Act 3019 or the Anti-graft and Corrupt Practices Act.


“One thing is sure, I will file graft and corrupt practices against them (Deloso and Galleto),” Palanan said.

Discontented with the direct bribery charges filed against the two police, Palanan would also seek remedies once he gets the copy of the prosecutor’s resolution.

Earlier, the NBI charged Deloso and Galleto with robbery with intimidation but was reduced to direct bribery by the prosecutor’s office.

Palanan handed the marked money of P2000 to Galleto and P6,000 to Deloso at a restaurant on Monday where agents from the NBI-10 arrested the police officers. Deloso tested negative on the fluorescent powder while Galleto tested positive. The result prompted the prosecutor’s office to reduce the charges from robbery with intimidation to direct bribery to ensure the case could prosper in Court.

Lawyer Dale Mordeno, lead counsel of Deloso and Galleto, said each of his clients paid P16,000 for their temporary liberty. Had the robbery with intimidation charges prospered, the two police would have paid P100,000 each for bail.

Mordeno said the court would raffle off the case on March 20, so they can already start preparing their answers to the allegations hurled against his clients.

City Prosecutor Fidel Macauyag, on TV Patrol, assured the law would always prevail. “Although he is a friend of some of our prosecutors, friendship is set aside in the application of the law,” Macauyag said.

Administrative case

Police Superintendent Michael Pareja, spokesperson of the Police Regional Office in northern Mindanao (PRO-10), said the Investigation and Detective Management Division of PRO-10 has been probing the case of Deloso and Galleto to file the appropriate administrative charges.

“The police officers should undergo due process. We assure the public of quick resolution. Usually administrative cases would take at most a month to get results,” Pareja said.

The penalties of the administrative charges would range from suspension to dismissal depending on the magnitude of the case.

Chief Superintendent Isagani Francisco Genabe Jr. said, “The PNP organization does not tolerate lawbreakers, with its propaganda Serbisyong Makatutuhanan.”

“PSupt. Deloso and PO3 Galleto committed illegal activity that is something not to emulate in the PNP. Instead, they will be punished accordingly so as not to affect the integrity of the Police Regional Office-10,” said Genabe on a statement released Wednesday.

Deloso and Galleto’s arrest stemmed from Palanan's complaint that Deloso allegedly demanded from the Xavier Heights Jeepney Operators and Drivers Association a ‘protection fee’ of P6,000 a month that have since begun in December 2013. (With a report from Loui S. Maliza)
