CA urged to cite Morales, de Lima in contempt

THE camp of Makati City Mayor Jejomar Erwin Binay Jr. asked the Court of Appeals (CA) on Thursday to cite in contempt Ombudsman Conchita Carpio-Morales and Justice Secretary Leila de Lima.

The supplemental petition was filed following the statements of Morales and de Lima that the temporary restraining order (TRO) issued by the CA Sixth Division against the suspension order imposed by the Ombudsman against Binay and 22 others came too late.

Morales and de Lima said the suspension order had been served even before the stay order was issued on Monday.

"Consequently, in the face of the persistent and wanton refusal of respondents to honor and comply with the lawful order of his Honorable Court, there is therefore an urgent need to cite respondents for indirect contempt and immediately mete out the appropriate punishment on them until they shall have complied with the TRO," the petition read.

The six-month preventive suspension without pay against Binay and the 22 others was in connection with the plunder and graft cases pending before the Ombudsman for the alleged overpriced construction of the Makati City Hall Building 2.

Binay earlier asked the CA to cite in contempt Department of Interior and Local Government (DILG) Secretary Manuel Roxas II, National Capital Region Police Office (NCRPO) chief Director Carmelo Valmoria and Makati City Vice Mayor Romulo Peña for allegedly defying the 60-day TRO issued by the CA.
