SolGen to reply on Jardaleza’s petition before SC-A A +A

MALACANANG said Saturday that the Office of the Solicitor General (OSG), on behalf of Executive Secretary Paquito Ochoa Jr., will reply on the petition of Solicitor General Francis Jardaleza questioning his exclusion from the list of nominees for the Associate Justice of the Supreme Court.
In an interview over dzRB Radyo ng Bayan, Deputy presidential spokesperson Abigail Valte admitted that it would be unusual that the OSG would be the one to answer a petition being made by the agency's head.
"It's a matter of filing a comment to the SolGen, to SolGen Jardeleza's petition. Medyo it's just a little unusual. It's an unusual situation because normally government is represented by the Office of the Solicitor General," she said.
But Valte noted that Jardaleza's petition was personal in nature.
"This petition is personal to SolGen Jardeleza because it's his qualifications that are—the meat or at least, iyong crux nung pinag-uusapan dito...beyond to separate the personal of SolGen Jardeleza, the OSG is there as an institution; it will be the one to answer in behalf of the Executive Secretary," she said.
The SC has ordered the Judicial and Bar Council (JBC) being chaired by Chief Justice Maria Lourdes Sereno and Ochoa to answer Jardaleza's petition to prevent President Benigno Aquino III from appointing a new Associate Justice to replace the post left by Associate Justice Roberto Abad.
Jardaleza has been questioning the JBC why he was removed from the shortlist of candidates to succeed Abad.
He accused the JBC of abusing its discretion.
"It's an unusual situation perhaps still the first that we've encountered in recent history, but, you know, we're used to unusual situations and we will proceed as procedure dictates," Valte said. (SDR/Sunnex)
