THE battle among members of the Board of Directors of Bacolod City Water District (Baciwa) continued Friday, as three other officials declared support for embattled general manager Juliana Carbon.
In a notice issued on Friday, lawyer Ma. Aida Torre, Cecilia Henares and Engr. Alfredo Bayanan, the sixth member appointed by the Local Water Utilities Administration (LWUA), stated that Carbon will remain in her position as general manager.
They said the resolution passed by their fellow directors Lawrence Villanueva, chairman of the board, Lorendo Dilag and Marichi Ramos to suspend Carbon is considered invalid as the meeting of the three directors does not constitute a quorum.
Under Presidential Decree 198, the number of votes was not enough to pass a resolution. Four votes are required to pass a resolution.
The order to preventively suspend Carbon for 30 days was illegal and invalid having been made by only three members of the Board and was done in violation of the Civil Service Commission rules on administrative cases, they added.
Villanueva, Dilag, and Ramos also held an "emergency meeting" Thursday to appoint former banker Darwin Destacamento of Kabankalan City as officer-in-charge of the Office of the General Manager.
However, the three other directors said, "We, therefore, do not recognize the appointment of Mr. Darwin D. Destacamento. Any action, instruction and transaction made by Mr. Destacamento to any agency, entity, office or person related to Bacolod City Water District will not be honored by the three directors Torre, Henares and Bayanin."
The Baciwa management and employees are further advised through general manager Carbon not to recognize any instruction or resolution made by only three members of Baciwa Board and Destacamento, they added.
Meanwhile, Destacamento was barred from entering the Baciwa premises on Friday.
Villanueva, Dilag and Ramos supposedly tasked Destacamento to serve as acting general manager pending the designation by LWUA chief Andres Ibarra of an interim general manager or the appointment of a regular general manager by the Board of Directors.
Since four senior management officials of Baciwa had earlier declined or expressed reluctance in assuming such designation, there is a primordial need to appoint temporarily a third person who is not an organic member of Baciwa as OIC general manager, the resolution of the three directors stated.
They also instructed Destacamento to hold office at the Baciwa Board Room.
