Ombud upholds ruling favoring Silay City execs

THE Office of the Ombudsman upheld the dismissal of the criminal and administrative complaints for gross negligence and conduct prejudicial to the best interest of service filed against Silay City officials led by Mayor Jose Montelibano and Vice Mayor Mark Andrew Golez.

It also dismissed the motion for reconsideration filed by complainant Jose Lindy Chan.

In a joint resolution dated February 25, 2014, the Ombudsman stated that the respondents were accused of approving an anomalous contract with Smart Communications.


It stated that in the assailed resolution and decision, the Ombudsman ruled that proper steps were taken by the respondents to ensure that the contract of lease of the City of Silay with Smart Communications would be beneficial and advantageous to the city and that there was no evidence of any irregularity.

In his motion, complainant Chan raised issues that the resolution did not have the signature and approval of the Deputy Ombudsman for the Visayas Pelagio Apostol and that the office made a mistake in ruling that the proper steps were taken by respondents to ensure that the contract of lease would be beneficial to the City of Silay.

Contrary to the claim of the complainant, the cost of the broadband internet service to be given as consideration for the lease of the subject properties which is P80,000 worth of internet access was not omitted from the contract of lease, adding that the description of the consideration remained the same, that is Smart broadband internet service with maximum internet speed of 2078 Kbps.

Other officials cleared by the Ombudsman are Councilors Jose Raymundo Locsin, Rosalinda Caja, Michael Maravilla, Mario Torres, Marie June Pavillar Castro, Ramon Jison, Michael Thomas Velez, and April Grace de los Reyes as well as City Administrator Ignacio Salmingo, City Legal Officer Kara Aimee Quevenco, OIC City Engineer Sonai Cordero and private individual Pancho Dino.
