‘Reinstate Ramos as CPDO chief’

THE Civil Service Commission (CSC) in Western Visayas Region has directed Bacolod City Mayor Monico Puentevella to immediately restore Jean Ramos to her position as City Government Department Head II and allow her to perform the duties and responsibilities that come with it


The order is contained in a decision of CSC Director IV Rodolfo Encajonado promulgated April 28, 2014.


She is entitled with the payment of her back salaries and benefits as City Planning and Development Coordinator along with her Representation and Transportation Allowance from the time she was illegally dropped from the rolls as department head of the City Planning and Development Office (CPDO) on February 7 until her actual reinstatement, the order further said.

This came after the CSC- Western Visayas granted the appeal of Ramos and reversed and set aside the Office Memorandum Order No. 010-02-14 dated February 7 issued by Puentevella, dropping her from the rolls.

The memorandum order issued by Puentevella that severed Ramos’ employment from the City Government cited that records of the Human Resource Management Services Office showed that she had been reported absent without leave (AWOL) since September 2013 up to the present.

On August 28, 2013, Ramos received from City Administrator Rolando Villamor a memorandum informing her of her transfer as department head of the CPDO to one of the offices of the Economic Enterprise which is a creation of a mere ordinance and not a department head position.

She filed a notice of appeal questioning the validity of the assignment order which resulted to her constructive dismissal.

In an order dated January 15, 2014, the CSC-Western Visayas had declared Ramos’ reassignment not in order and directed her immediate reinstatement to her former position as CPDO head.

Instead of complying with the decision of the CSC, Puentevella issued Memorandum No. 010-02-14, declaring Ramos as being Awol and thus, separating her from employment and dropping her from the rolls, Encajonado said.

“That left with no recourse, complainant (Ramos) again comes to the refuge of this Honorable Office for redress as she is no match to the power and authority of the respondent (Puentevella) which he employed to the hilt to get rid of the complainant from the employment with the city government,” he said.

Encajonado said the reassignment of Ramos from CPDO head to one of the offices of the Economic Enterprise had already been declared by the CSC as “not in order.”

“Hence, Ramos cannot be compelled to comply with an illegal order issued by Puentevella. Corollary, her decision of not reporting for work at the Economic Enterprise Office is legal and justifiable,” he said.

The ground relied upon by Puentevella in terminating the employment of Ramos from government service is due to abandonment of work. However, Ramos never abandoned her work, Encajonado said.

In fact, Ramos immediately made steps and filed a complaint for constructive dismissal against Puentevella and prayed that she would be reinstated to her position as CPDO head, a clear indication that she does not want to abandon her work as CPDO head, he said.

Ramos was appointed as CPDO head on February 16, 2013 under permanent status by former mayor and now Bacolod City Rep. Evelio Leonardia.

Barely two months after Puentevella assumed as mayor, he issued Memorandum Order 052-8-13 dated August 28, 2013 reassigning Ramos to the Local Economic Enterprise while temporarily stationed at the City Administrator’s Office.

Puentevella designated Ana Ma. Principe as officer-in-charge of the CPDO in lieu of Ramos.
