City Hall to appeal CSC ruling

BACOLOD City Mayor Monico Puentevella said Friday that he will file a motion for reconsideration on the Civil Service Commission in Western Visayas (CSC-6) ruling directing him to reinstate Jean Ramos to her station as head of the City Planning and Development Office.

Puentevella said over ABS-CBN Bacolod that, while Ramos was appealing her case before the CSC, she went absent without leave (Awol).

Ramos should have continued reporting to work while appealing the case, but because she did not, that is another story, the mayor said.


Ramos asked Puentevella to respect the order of the CSC saying “he should respect the law because no one is above the law.”

In a decision dated January 15, 2014, CSC Director IV Rodolfo Encajonado ruled that the memorandum order issued by Puentevella dated August 23, 2013 which caused the transfer of Ramos to the Economic Enterprise unit is not in order.

Encajonado added that Puentevella should allow Ramos to perform the duties and responsibilities of her position as City Government Department Head II.

In her complaint against Puentevella and the City of Bacolod, she said that her transfer to another office is illegal and motivated by politics.

Ramos, wife of former Councilor Dindo Ramos, said that last August 28, she received a memorandum from City Administrator Rolando Villamor informing her of her transfer to the Economic Enterprise office, which is not a department head position.

She was appointed by former Mayor Evelio Leonardia on February 16, 2013 as department head of the CPDO with concurrence from the City Council.

Ramos said her transfer to “one of the offices of Economic Enterprise” is illegal since it was done without due process of law.

She added that simultaneous to the receipt of the memorandum for her transfer was the issuance of the memorandum appointing her subordinate, Ana Ma. Carmen Principe, the officer-in-charge of the CPDO.

Ramos said her assignment to a mere office is a clear case of demotion as she was appointed as department head of the CPDO, a position which is created by a statute with defined and specific functions, and resulted to diminution in her salary and benefit as she will be deprived of her monthly Representation Allowance and Transportation Allowance.
